Terms of Service
These Terms of Service ("Terms") govern your access to and use of the QuickCal platform and services ("Service"), operated by QuickCal ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. The Service
QuickCal provides an AI-powered scheduling and dispatch platform for small businesses, including an AI voice agent that handles inbound calls, collects job information, offers appointment slots, and sends automated SMS and email notifications.
The Service is intended for business use only. You must be at least 18 years old and have the authority to bind your business to these Terms to use the Service.
2. Account Registration
You must create an account to use the Service. You agree to provide accurate, complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at legal@quick-cal.com if you suspect unauthorized access.
3. SMS Messaging and Telephone Communications
By using the Service, you authorize QuickCal to send automated SMS messages on your behalf to:
- Your customers and callers, using contact information they provide to your AI voice agent
- You and your team members, for lead alerts and operational notifications
You are solely responsible for ensuring you have appropriate consent from your customers to receive SMS communications. You agree to comply with all applicable laws and regulations governing SMS and telephone communications, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.
You agree not to use the Service to send unsolicited messages, spam, or communications that violate applicable law.
Recipients can opt out of SMS messages by replying STOP. You agree to honor all opt-out requests promptly.
4. AI Voice Agent
The Service includes an AI-powered voice agent that handles inbound calls to your business. You acknowledge that:
- The AI agent will identify itself as an automated scheduling assistant when asked
- Call transcripts and collected caller information will be stored in your account
- You are responsible for complying with any applicable call recording and disclosure laws in your jurisdiction
- The AI agent is designed for scheduling and intake purposes only and should not be used for medical, legal, financial, or emergency services
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Impersonate any person or entity or misrepresent your affiliation
- Use the Service to harass, abuse, or harm others
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to any part of the Service
- Use the Service to send emergency communications — the AI agent is not a substitute for emergency services
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for the lawful collection and use of your customers' personal information through the Service.
You grant us a limited license to process data you and your callers provide solely to operate and improve the Service. We do not sell your data or your customers' data to third parties.
7. Fees and Payment
Access to the Service may require payment of subscription fees as described on our pricing page at https://quick-cal.com/pricing. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days notice. Failure to pay may result in suspension or termination of your account.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by QuickCal and protected by intellectual property laws. You retain ownership of any data and content you submit to the Service. You grant us a limited license to use your content solely to provide the Service.
9. Third-Party Services
The Service integrates with third-party services including Twilio, Retell AI, Cal.com, Supabase, and others. Your use of these integrations is subject to their respective terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
THE AI VOICE AGENT MAY MAKE ERRORS IN TRANSCRIPTION, SCHEDULING, OR COMMUNICATION. YOU ARE RESPONSIBLE FOR REVIEWING ALL APPOINTMENTS AND COMMUNICATIONS GENERATED BY THE SERVICE.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, QUICKCAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless QuickCal and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party rights.
13. Termination
Either party may terminate the Service relationship at any time. We may suspend or terminate your account immediately for violation of these Terms. Upon termination, your right to use the Service ceases and we may delete your account data in accordance with our data retention policy.
14. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Utah County, Utah.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide at least 14 days notice of material changes by email or through the Service. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
